(EN) GENERAL STANDARD TERMS AND CONDITIONS<\/h3>

Area of application<\/b><\/span><\/p>

These general terms and conditions are binding. They are based on Swiss law and apply within Switzerland. By ordering goods, the buyer declares that he has taken\u00a0<\/span>note of and accepted the GTC. Conditions to the contrary or additional agreements shall only be valid if they have been accepted by Diotrol AG<\/span>.<\/span><\/p>

Prices<\/b><\/span><\/p>

Prices are subject to change without notice and do not include value-added tax and VOC steering tax.<\/span><\/p>

Note on the delivered colours<\/b><\/span><\/p>

Colour tones, pre-mixtures and re-mixtures must be checked before application. Slight colour differences are possible due to the raw materials used. In the colour\u00a0<\/span>spectrum, the colour tones are produced as accurately as possible according to the available samples. Degree of gloss and difference in structure (pattern or colour\u00a0<\/span>card compared to the object) can lead to certain colour differences. Replacement entitlements due to colour inaccuracy or colour mix-up cannot be asserted after\u00a0<\/span>processing. Special pre-mixtures and re-mixtures cannot be returned.<\/span><\/p>

Note on the glaze colour tones<\/b><\/span><\/p>

The colour tone and thus also the colour perception are very strongly dependent on the wood substrate. For this reason, we would like to point out that a sample\u00a0<\/span>should always be produced for glaze shades on customer wood and should also be approved by the customer.<\/span><\/p>

Terms of delivery and payment<\/b><\/span><\/p>

1.<\/span><\/p>

All orders shall be accepted or executed on the basis of the following conditions. By placing orders, the customer acknowledges these<\/span><\/p>

terms of delivery and payment. Additional verbal agreements require a written confirmation of the supplier to be binding.<\/span><\/p>

2.<\/span><\/p>

Deliveries in Switzerland:\u00a0If the invoice amount reaches Fr. 500, all articles will be delivered for free domestically; if the invoice amount is less, the\u00a0<\/span>shipping fee will be invoiced separately. For resellers, the free postage limit is 300 litres per delivery. For deliveries with an own vehicle or by a forwarding\u00a0<\/span>company, a Fr 40.00 lump charge is billed per shipment.<\/span><\/p>

Deliveries abroad:\u00a0Minimum purchase quantity in consultation with our sales department.<\/span><\/p>

Transport damages:\u00a0All goods travel at the expense and risk of the buyer. Transport damages (such as deficiencies, breakage, damage, etc.) are to be\u00a0<\/span>claimed by the recipient on the day of delivery from the transport company concerned.<\/span><\/p>

3.<\/span><\/p>

Invoices must be paid net within 30 days of the date of the invoice. In the event of default in payment, interest on arrears shall be charged from the due\u00a0<\/span>date after prior notice of default has been given.<\/span><\/p>

4.<\/span><\/p>

The supplier warrants the proper composition of the delivered goods and their suitability for the expressly ensured purpose of use. No extensive\u00a0<\/span>liability is assumed, in particular not for defects resulting from the application.<\/span><\/p>

5.<\/span><\/p>

Immediately recognisable defects can only be claimed before use or mixing of the goods at the latest 8 days after receipt. Any defects noticed do not\u00a0<\/span>release the customer from his obligation to comply with the terms of delivery and payment.<\/span><\/p>

6.<\/span><\/p>

A properly filed and justified notice of defect shall oblige the supplier (taking due account of the buyer’s interests) to reduce the price, repair or exchange\u00a0<\/span>the goods and, if necessary, take them back. In the case of material damage, claims for damages can only be asserted up to the good\u2019s value at\u00a0<\/span>most.<\/span><\/p>

7.<\/span><\/p>

Unless otherwise agreed in writing, the warranty period shall be one year. Defects may be reported at any time within this period.<\/span><\/p>

8.<\/span><\/p>

Claims for damages due to defects in the goods shall become statute-barred one year after their processing by the purchaser. However, these claims\u00a0<\/span>for compensation can only be asserted if the processing takes place within 6 months of receipt of the goods.<\/span><\/p>

9.<\/span><\/p>

All incidents and facts beyond the influence and control of the supplier shall be considered as force majeure and shall release the supplier from any\u00a0<\/span>warranty and shipment obligations.<\/span><\/p>

Technical information (info sheets)<\/b><\/span><\/p>

The buyer undertakes to take note of the technical information provided to him and to follow the recommendations contained therein. The technical information is\u00a0<\/span>compiled according to the state of the art. They are only non-binding information and recommendations. Any liability for the general validity of the technical information\u00a0<\/span>must be excluded, as the use of the products and the processing methods are beyond our control. In the event that products are changed (due to technical\u00a0<\/span>progress), the respective new guidelines apply. The different nature of the sub-surfaces requires that the method of working is aligned with proper professional and\u00a0<\/span>craft aspects.<\/span><\/p>
