(EN) GENERAL STANDARD TERMS AND CONDITIONS

Area of application

These general terms and conditions are binding. They are based on Swiss law and apply within Switzerland. By ordering goods, the buyer declares that he has taken note of and accepted the GTC. Conditions to the contrary or additional agreements shall only be valid if they have been accepted by Diotrol AG.

Prices

Prices are subject to change without notice and do not include value-added tax and VOC steering tax.

Note on the delivered colours

Colour tones, pre-mixtures and re-mixtures must be checked before application. Slight colour differences are possible due to the raw materials used. In the colour spectrum, the colour tones are produced as accurately as possible according to the available samples. Degree of gloss and difference in structure (pattern or colour card compared to the object) can lead to certain colour differences. Replacement entitlements due to colour inaccuracy or colour mix-up cannot be asserted after processing. Special pre-mixtures and re-mixtures cannot be returned.

Note on the glaze colour tones

The colour tone and thus also the colour perception are very strongly dependent on the wood substrate. For this reason, we would like to point out that a sample should always be produced for glaze shades on customer wood and should also be approved by the customer.

Terms of delivery and payment

All orders shall be accepted or executed on the basis of the following conditions. By placing orders, the customer acknowledges these

terms of delivery and payment. Additional verbal agreements require a written confirmation of the supplier to be binding.

Deliveries in Switzerland: If the invoice amount reaches Fr. 500, all articles will be delivered for free domestically; if the invoice amount is less, the shipping fee will be invoiced separately. For resellers, the free postage limit is 300 litres per delivery. For deliveries with an own vehicle or by a forwarding company, a Fr 40.00 lump charge is billed per shipment.

Deliveries abroad: Minimum purchase quantity in consultation with our sales department.

Transport damages: All goods travel at the expense and risk of the buyer. Transport damages (such as deficiencies, breakage, damage, etc.) are to be claimed by the recipient on the day of delivery from the transport company concerned.

Invoices must be paid net within 30 days of the date of the invoice. In the event of default in payment, interest on arrears shall be charged from the due date after prior notice of default has been given.

The supplier warrants the proper composition of the delivered goods and their suitability for the expressly ensured purpose of use. No extensive liability is assumed, in particular not for defects resulting from the application.

Immediately recognisable defects can only be claimed before use or mixing of the goods at the latest 8 days after receipt. Any defects noticed do not release the customer from his obligation to comply with the terms of delivery and payment.

A properly filed and justified notice of defect shall oblige the supplier (taking due account of the buyer’s interests) to reduce the price, repair or exchange the goods and, if necessary, take them back. In the case of material damage, claims for damages can only be asserted up to the good’s value at most.

7.

Unless otherwise agreed in writing, the warranty period shall be one year. Defects may be reported at any time within this period.

Claims for damages due to defects in the goods shall become statute-barred one year after their processing by the purchaser. However, these claims for compensation can only be asserted if the processing takes place within 6 months of receipt of the goods.

9.

All incidents and facts beyond the influence and control of the supplier shall be considered as force majeure and shall release the supplier from any warranty and shipment obligations.

Technical information (info sheets)

The buyer undertakes to take note of the technical information provided to him and to follow the recommendations contained therein. The technical information is compiled according to the state of the art. They are only non-binding information and recommendations. Any liability for the general validity of the technical information must be excluded, as the use of the products and the processing methods are beyond our control. In the event that products are changed (due to technical progress), the respective new guidelines apply. The different nature of the sub-surfaces requires that the method of working is aligned with proper professional and craft aspects.
