Scope

These general terms and conditions are binding. They are based on Swiss law and apply within Switzerland. By ordering the goods, the buyer declares that he has taken note of and accepted the GTC. Other conditions or additional agreements are only valid if they have been accepted by Maurolin AG, Diotrol AG, Diolin AG. 

Prices

Prices are subject to change and exclusive of VAT and exclusive of VOC steering tax.

Note on shade deliveries

Color shades, mixing and post-mixing must be checked before application. Slight differences in color shade are possible due to the raw materials used. In the color area, the shades are produced as accurately as possible according to the available samples. Gloss level and texture difference (sample or color chart compared to the object) can lead to certain color tone differences. Claims for compensation due to color shade inaccuracy or color shade confusion cannot be asserted after processing. Special out- and remixes cannot be taken back.

Note on glaze shades

The color tone and thus also the color perception are very strongly dependent on the wood substrate. For this reason, we would like to point out that in the case of glaze shades, a sample made on the customer’s wood should always be produced and this should also be approved by the customer.

Terms of delivery and payment

All orders are accepted on the basis of the following terms and conditions. executed.

By placing orders, the customer accepts these terms of delivery and payment. Additional verbal agreements require written confirmation to obligate the supplier.

2.

Deliveries in Switzerland: If the invoice amount reaches Fr. 500, all articles shall be delivered carriage paid to the domicile; if the price is less than this, likewise in the case of postal consignments, the freight shall be invoiced separately. For resellers, the franc limit is 300 liters per delivery. For deliveries by own vehicle or by transport companies, a flat-rate freight charge of Fr. 40.- per shipment will be charged.

Deliveries abroad: minimum purchase quantity in consultation with our sales department.

Damage in transit: All goods travel for the account and at the risk of the buyer. Transport damage (such as shortage, breakage, damage, etc.) must be claimed by the recipient on the day of delivery to the relevant transport company.

Invoices are payable net within 30 days from the date of the invoice. In the event of late payment, after prior notice of default, interest on arrears will be charged from the due date.

4.      

The supplier warrants the proper composition of the delivered goods and their suitability for the expressly warranted purpose. No extensive liability is assumed, in particular for defects resulting from the application.

5.      

Immediately recognizable defects can only be claimed before the goods are used or mixed, at the latest 8 days after receipt. Any notices of defects shall not release the customer from compliance with the terms of delivery and payment.

6.      

A duly made and justified notice of defects obligates the supplier (with due consideration of the interests of the purchaser) to grant a price reduction, rectification or exchange and, if necessary, to take back the goods. Claims for damages can be asserted in the case of property damage up to the value of the goods at the most.

7.      

Unless otherwise agreed in writing, the warranty period shall be one year. Within this period, the defect may be notified at any time.

8.      

Claims for damages due to defects of the goods shall become statute-barred one year after their processing by the Buyer. However, these claims for compensation can only be asserted if the processing takes place within 6 months after receipt of the goods.

9.      

All events and facts beyond the supplier’s influence and control shall be considered as force majeure and shall release the supplier from any warranty liability and delivery obligation.

 

Technical information (leaflets)

The Purchaser undertakes to take note of the technical information provided to him and to comply with the recommendations set forth therein.

The technical information is compiled according to the latest state of the art. They are valid only as non-binding information and recommendations. Any liability for the general validity of the technical information must be excluded, since the application of the products and the processing methods are beyond our control. In the event of changes to the products (due to technical progress), the respective new guidelines apply.

The different nature of the substrates requires that the working method be coordinated according to professional and craftsmanlike aspects.

Domaine d’application

Les présentes conditions générales sont contraignantes. Elles sont basées sur le droit suisse et s’appliquent en Suisse. En commandant la marchandise, l’acheteur déclare avoir pris connaissance et accepté les CG. Les conditions contraires ou supplémentaires ne sont valables que si elles ont été acceptées par Maurolin AG, Diotrol AG, Diolin AG.

Prix

Les prix sont sujets à changement sans préavis et hors taxe sur la valeur ajoutée et taxe d’incitation sur les COV.

Remarque sur les livraisons des teintes

Les teintes, les prémélanges et les post-mélanges doivent être vérifiés avant l’application. De légères différences de teinte sont possibles en raison des matières premières utilisées. Dans la gamme de couleurs, les nuances de couleurs sont produites aussi précisément que possible en fonction des échantillons disponibles. Le degré de brillance et la différence de structure (motif ou carte de couleurs par rapport à l’objet) peuvent entraîner certaines différences de teinte. Après le traitement, il est impossible de faire valoir des droits à des dommages-intérêts en raison d’une imprécision ou d’une confusion de teintes. Les prémélanges et postmélanges spéciaux ne peuvent pas être renvoyés.

Remarque sur les produits teintés

La teinte et ainsi la perception de la couleur dépendent fortement du support en bois. C’est la raison pour laquelle nous tenons à souligner que, en ce qui concerne les produits teintés, un échantillon réalisé sur le bois du client doit toujours être produit puis approuvé par le client.

Conditions de livraison et de paiement

1. toutes les commandes sont acceptées ou traitées sur la base des conditions suivantes. En passant une commande, le client accepte les présentes conditions générales de livraison et de paiement. Les accords verbaux supplémentaires doivent être confirmés par écrit par le fournisseur afin d’être contraignants.

2 Livraisons en Suisse : si le montant de la facture atteint 500 CHF, tous les articles seront livrés franco domicile ; s’il est inférieur, de même pour les envois postaux, le fret sera facturé séparément. Pour les revendeurs, le seuil de livraison gratuite s’élève à 300 liters par livraison. Pour les livraisons avec un véhicule propre ou par des entreprises de transport, une participation aux frais de transport de 40 CHF sera facturée par envoi.

Livraisons à l’étranger: Quantité minimum de commande en concertation avec notre service commercial.

Dommages dus au transport: Toutes les marchandises sont transportées aux frais et risques de l’acheteur. Les dommages dus au transport (tels que défauts, bris, avaries, etc.) doivent être déclarés par le destinataire le jour de la livraison auprès de l’entreprise de transport concernée.

3. factures doivent être payées nettes dans les 30 jours suivant la date de la facture. En cas de retard de paiement, des intérêts moratoires seront facturés à compter de la date d’échéance après mise en demeure préalable.

Information techniques (fiches techniques)

L’acheteur s’engage à prendre connaissance des informations techniques qui lui sont fournies et à respecter les recommandations qu’elles contiennent. Les informations techniques sont compilées selon l’état de l’art. Il ne s’agit que d’informations et de recommandations non contraignantes. Toute responsabilité pour la validité générale des informations techniques doit être exclue, car l’utilisation des produits et les méthodes de traitement sont hors de notre contrôle. En cas de modification des produits (en raison du progrès technique), les nouvelles directives correspondantes s’appliquent. La méthode de travail doit être adaptée à la nature du support sur le plan de la technique et de la compétence.

Note on the delivered colors

Color tones, pre-mixtures and re-mixtures must be checked before application. Slight color differences are possible due to the raw materials used. In the color spectrum, the color tones are produced as accurately as possible according to the available samples. Transport damages: All goods travel at the expense and risk of the buyer. Transportation damages (such as deficiencies, breakage, damage, etc.) are to be claimed by the recipient on the day of delivery from the transport company concerned.
